Common Situations
Every Estate Is Different
Here are some of the situations families often find themselves in. Whatever yours looks like, we’ll work through it together.

Selling During Probate
Once the executor or administrator has authority to act, the home can often be listed. Your attorney will confirm what’s required; I’ll handle pricing, marketing and showings.
Inherited a Home Out of State
Live far from Houston? I can be your eyes on the ground: checking on the property, meeting vendors, sharing photos and video, and arranging remote signing where possible.
Multiple Heirs
When several family members share an interest, clear information helps. I’ll provide the same market data and updates to everyone, while your attorney guides any decisions that need agreement.
Home Needs Repairs or Clean-Out
Many inherited homes are full of belongings or need updates. We’ll decide together what’s worth doing before listing and what’s better left for the next owner.
Keeping vs. Selling vs. Renting
Not sure what to do with the home? I’ll share what it may sell for and what it may rent for, so you can weigh your options with your attorney and tax advisor.
Tenant-Occupied Inherited Property
If someone is renting the home, their lease and rights still matter. I’ll help you review the lease and plan showings respectfully, with your attorney guiding any legal questions.

Answers to Common Probate Real Estate Questions
Can I sell a house before probate is finished?
Often, yes, once the executor or administrator has legal authority to act for the estate. Depending on the type of administration, a sale may or may not need court approval. Your probate attorney will tell you exactly what’s required, and I’ll plan the listing around those steps.
Who has the authority to sell an inherited home?
Usually the executor named in the will or a court-appointed administrator, once they’ve received their authority from the court. In some situations heirs may own the property directly. Because this depends on the estate, your attorney should confirm who can sign before we list.
Do we have to fix up the house before selling?
No. Some families choose a few simple updates or a deep clean; others sell as-is. I’ll walk through the home with you and explain how condition may affect price and buyer interest, so you can make the choice that fits the estate.
What if the heirs don’t agree on selling?
Disagreements are common and understandable. I can provide clear market information so everyone is working from the same facts, but questions about who decides and how should go to your probate attorney.
Are there taxes when you sell an inherited home?
There can be, and the rules depend on the estate and each heir’s situation. Please talk with a tax professional before the sale so you understand any reporting or tax effects. I can provide the market and sale information they may ask for.
Do I need to live in Houston to handle the sale?
Not at all. I regularly communicate by phone, email and video, can meet vendors at the property, and can help arrange remote or mail-away signing with the title company where available.

Probate requirements vary by estate and by the type of administration. Please consult a probate attorney about the legal process and a tax professional about any tax questions before making decisions about the property.
